This Privacy Policy explains how BIOCUBE LLC, its affiliated companies, brands, franchisees, licensees, operators, facilities, and participating locations operating under the BIOCUBE name or related BIOCUBE programs collect, use, disclose, and protect information.
For purposes of this Privacy Policy, “BIOCUBE,” “we,” “us,” and “our” refer to BIOCUBE LLC and, where applicable, participating BIOCUBE locations, franchisees, affiliated brands, and service operators. “Services” means our websites, landing pages, digital platforms, booking systems, membership programs, day passes, communications, franchise inquiry forms, wellness facilities, recovery services, fitness services, performance services, longevity services, wellness rooms, wellness centers, corporate wellness programs, residential or hospitality wellness installations, and related services.
This Privacy Policy applies to information collected online, in person, by phone, by email, by SMS, through WhatsApp or other messaging platforms, through automated or AI-assisted communications, through booking or membership systems, and through use of BIOCUBE facilities and services.
If a specific franchisee, property partner, healthcare provider, payment processor, booking platform, or third-party service provider maintains its own privacy policy, that policy may also apply to information it collects directly.
BIOCUBE’s core wellness, recovery, fitness, and performance services are intended for general wellness and are not a substitute for professional medical care, diagnosis, or treatment. Except where a separate written HIPAA Notice of Privacy Practices is provided for a specific healthcare service, BIOCUBE is not acting as a HIPAA-covered healthcare provider, and information collected through general wellness services is not treated by BIOCUBE as protected health information under HIPAA. Such information may still be protected by other federal or state privacy, consumer protection, health data, breach notification, or security laws.
1. Information We Collect
We collect information that you provide directly, information generated through your use of our Services, information collected automatically through our websites and digital tools, and information we receive from franchisees, affiliates, service providers, property partners, corporate wellness partners, and other authorized sources.
A. Personal and Contact Information
We may collect information such as your name, email address, phone number, mailing address, date of birth or age confirmation, account username, password or login credentials, emergency contact information, preferred location, membership status, communication preferences, and records of your inquiries or requests.
B. Membership, Booking, and Account Information
We may collect information related to memberships, day passes, bookings, class or session reservations, check-ins, cancellations, membership freezes, account activity, visit history, usage history, facility access, referral activity, waiver status, and customer support interactions.
C. Wellness, Recovery, Fitness, and Performance Information
Depending on the Services you use, we may collect wellness-adjacent, fitness, recovery, performance, and consumer health-related information, including body composition data, InBody or similar scan results, fitness goals, recovery goals, training history, recovery history, device usage logs, session history, wellness questionnaires, contraindication screening responses, injury disclosures, limitations, comfort preferences, wellness assessments, progress notes, staff observations related to service use, and digitally signed waivers, releases, consent forms, and agreements.
Depending on the location and available services, this may include information related to use of wellness, longevity, recovery, fitness, or performance technologies such as body composition scanners, compression devices, red light devices, saunas, contrast therapy, cold therapy, oxygen or hyperbaric-related wellness devices, fitness equipment, guided recovery systems, or other wellness technologies.
You should not provide medical records, diagnostic information, prescriptions, lab results, or other clinical information unless specifically requested for safety screening or required for a particular service. Information you voluntarily provide is used for wellness, safety, operational, and service-related purposes and is not used by BIOCUBE to diagnose, treat, cure, or prevent disease.
We collect information necessary to process memberships, free trials, day passes, recurring subscriptions, purchases, billing, payment disputes, refunds, cancellations, and related account administration.
Payments are processed by third-party payment processors. BIOCUBE does not intentionally store full credit card numbers on its own servers. Payment processors may store tokenized payment credentials, transaction history, billing address, card brand, expiration date, and other payment-related information in accordance with their own privacy and security practices.
E. Franchise, Business, and Partner Inquiry Information
If you inquire about franchising, licensing, corporate wellness, property partnerships, investment opportunities, or business relationships, we may collect business contact information, company name, role or title, territory interest, investment range, professional background, financial qualification information, preferred market, communications, application materials, and related due diligence information.
F. Facility, Safety, and Security Information
At physical locations, we may collect check-in logs, access records, incident reports, accident reports, equipment usage information, waiver confirmations, guest records, and security-related information. Some locations may use cameras or video monitoring in common areas for safety, security, loss prevention, and operational purposes. Cameras are not intended for use in private changing, restroom, or similar areas.
We do not use facial recognition or biometric identifiers to identify individuals unless we provide a clear notice and obtain consent where required by law.
G. Communications Information
We may collect and store communications with you, including emails, text messages, WhatsApp messages, website form submissions, chat messages, AI-assisted conversations, customer support tickets, voicemail, phone call notes, reviews, survey responses, and social media interactions.
Where permitted by law, calls or digital communications may be monitored, recorded, transcribed, summarized, or analyzed for customer service, training, quality assurance, safety, dispute resolution, and operational improvement.
H. Automatically Collected Website and Device Information
When you visit our websites, landing pages, advertisements, booking portals, or digital platforms, we may automatically collect IP address, device identifiers, browser type, operating system, referring URLs, pages viewed, buttons clicked, forms started or submitted, time spent on pages, session duration, approximate location, cookie identifiers, advertising identifiers, and analytics data.
This information may be collected through cookies, pixels, tags, software development kits, log files, analytics tools, advertising technologies, and similar tracking technologies.
I. Information About Minors
BIOCUBE facilities and Services may be used by minors only with consent from a parent or legal guardian and subject to applicable membership agreements, waivers, facility rules, and age restrictions.
Our websites and online services are not directed to children under 13. We do not knowingly collect personal information online from children under 13 without verifiable parental consent. If we learn that we have collected personal information from a child under 13 without required consent, we will delete it or take other legally required action.
2. How We Use Information
We use information to provide, operate, manage, improve, and protect BIOCUBE Services. This includes using information to create and manage accounts; schedule and confirm sessions; process memberships, payments, renewals, freezes, cancellations, and refunds; provide day passes or promotional offers; verify eligibility; support facility access; personalize wellness and recovery experiences; document waivers, releases, and consents; screen for service suitability and safety; respond to inquiries; provide customer support; communicate service updates; manage franchise and corporate operations; train staff; improve member experience; monitor equipment and facility usage; detect fraud or misuse; protect safety and security; comply with legal obligations; enforce agreements; and resolve disputes.
We may also use information for marketing, advertising, analytics, retargeting, audience measurement, campaign performance, referral programs, surveys, promotions, loyalty programs, and similar business purposes, subject to your privacy choices and applicable law.
We may create aggregated, anonymized, or deidentified data that does not reasonably identify you. We may use such data for analytics, reporting, operations, benchmarking, business planning, franchise support, and service improvement.
3. Wellness and Consumer Health Data Notice
Some wellness, recovery, body composition, fitness, performance, and device usage information may be considered “consumer health data,” “sensitive personal information,” “biometric data,” or similar regulated information under certain state privacy laws, even when the information is not protected health information under HIPAA.
The categories of wellness or consumer health-related data we may collect include body measurements, body composition data, fitness and recovery goals, performance metrics, wellness questionnaires, contraindication screening responses, injury or limitation disclosures, device session logs, service usage history, recovery history, facility check-in history, and information you voluntarily provide about your physical condition or wellness preferences.
We collect this information from you directly, from your use of BIOCUBE Services, from BIOCUBE staff or franchise operators, from devices used during Services, from booking and membership systems, and from service providers that support our operations.
We use this information to provide requested Services, support safety screening, personalize your experience, manage memberships, maintain records, improve services, train staff, operate franchise systems, support customer service, comply with legal obligations, and protect the rights, safety, and security of BIOCUBE, our members, guests, staff, franchisees, and partners.
We do not sell consumer health data for money. We do not use consumer health data for targeted advertising or cross-context behavioral advertising unless permitted by law and, where required, with your consent. We do not use geofencing around healthcare facilities to identify, track, or target individuals based on consumer health data.
Where applicable law provides specific consumer health data rights, you may have the right to request access to consumer health data we maintain about you, request deletion, withdraw consent, obtain a list of certain third parties or affiliates with whom consumer health data has been shared, or appeal a denial of your request. Requests may be submitted using the contact information at the end of this Privacy Policy.
4. How We Share Information
We may share information with the following categories of recipients:
BIOCUBE affiliates, franchisees, licensees, operators, and participating locations, for membership administration, service delivery, scheduling, customer support, franchise operations, reporting, quality control, training, safety, and business management.
Service providers and processors, including payment processors, booking and scheduling platforms, CRM providers, email marketing platforms, SMS and messaging platforms, website hosting providers, analytics providers, advertising platforms, IT support providers, cloud storage providers, waiver and document-signature platforms, customer support tools, security providers, and professional advisors.
Property, employer, hospitality, residential, corporate wellness, or facility partners, where Services are provided through or inside a third-party property, workplace, building, hotel, fitness center, association, or corporate wellness program. We may share information necessary to confirm eligibility, access rights, program participation, billing, usage reporting, or operational support. We do not provide detailed individual wellness data to employers, property owners, or similar partners for employment, housing, insurance, credit, or similar decisions unless you consent or the disclosure is legally required.
Advertising and analytics partners, who may receive online identifiers, cookie data, device data, website activity, and similar digital interaction data. These partners may use such data to measure campaigns, personalize ads, retarget visitors, and analyze traffic, subject to applicable law and your privacy choices.
Emergency contacts, medical personnel, first responders, or authorities, where reasonably necessary to protect your health, safety, or security or the health, safety, or security of others.
Legal, regulatory, and professional parties, including lawyers, auditors, insurers, accountants, regulators, courts, law enforcement, and governmental authorities where required or permitted by law.
Business transaction parties, in connection with a merger, acquisition, financing, franchise transfer, reorganization, sale of assets, bankruptcy, due diligence process, or other business transaction involving BIOCUBE or a participating location.
Other parties with your consent or at your direction.
When third parties act as our service providers or processors, we require them to use information only for the services they provide to us and to protect the information appropriately. Some third parties, such as payment processors, advertising platforms, social media platforms, booking systems, or property partners, may process information under their own privacy policies.
5. Cookies, Pixels, Analytics, and Advertising
We use cookies and similar technologies to operate our websites, remember preferences, enable forms and booking features, analyze website traffic, measure campaign performance, improve user experience, detect fraud or abuse, and deliver or measure advertising.
These technologies may include Google Analytics, Google Ads, Meta/Facebook Pixel, social media pixels, retargeting tags, CRM tracking tools, heat-mapping tools, and similar services.
You can control cookies through your browser settings. Some browsers, plug-ins, and devices allow you to block or delete cookies or limit tracking. If you disable cookies, some website features may not work properly.
Where required by law, we will honor applicable opt-out preference signals, such as Global Privacy Control, for activities recognized by applicable law as a sale, sharing, or targeted advertising. You may also use any cookie preference tool available on our website.
We do not control third-party platforms after you leave our website or interact with third-party services. Their privacy practices are governed by their own policies.
6. Communications, SMS, WhatsApp, Automated Calls, and AI-Assisted Messaging
By providing your email address, phone number, or messaging handle, you agree that BIOCUBE, participating locations, franchisees, affiliates, and service providers may contact you about your account, bookings, memberships, purchases, facility access, waivers, service updates, customer support, safety notices, promotions, and marketing.
Communications may be sent by email, SMS/text message, phone call, automated call, WhatsApp, push notification, chat, or AI-assisted messaging. Message frequency may vary. Message and data rates may apply.
Consent to receive marketing communications is not a condition of purchase. You may opt out of marketing emails by using the unsubscribe link in the email. You may opt out of SMS/text marketing by replying STOP or following the instructions in the message. You may request help by replying HELP where supported.
Even after you opt out of marketing communications, we may still send transactional or service-related communications, such as booking confirmations, payment notices, account updates, policy updates, safety notices, or responses to your requests.
We may use AI-assisted tools to draft, route, personalize, summarize, or improve communications. AI tools do not make legally significant decisions about you without human oversight and are not used to provide medical diagnosis or treatment.
7. Memberships, Subscriptions, Billing, and Cancellations
If you purchase a membership, subscription, package, or recurring service, we and our payment processors may use your information to process recurring payments, maintain billing records, manage renewals, handle failed payments, apply promotions, process cancellations, issue refunds where applicable, and enforce membership terms.
Auto-renewal, cancellation, freeze, refund, and billing terms are governed by the applicable membership agreement, purchase terms, franchise location rules, or other written agreement provided at the time of purchase.
8. Data Retention
We retain information for as long as reasonably necessary to provide Services, manage accounts, comply with legal obligations, maintain business records, resolve disputes, enforce agreements, prevent fraud, support safety and security, comply with tax and accounting obligations, and operate franchise systems.
Membership records, billing records, waivers, consent forms, incident reports, facility access logs, and dispute-related records may be retained after account termination where necessary for legal, operational, insurance, accounting, safety, or compliance purposes.
When information is no longer needed, we may delete, deidentify, aggregate, or securely retain it as permitted by law.
9. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, loss, misuse, or destruction. These safeguards may include access controls, vendor controls, staff training, account protections, encryption where appropriate, monitoring, physical security measures, and data minimization practices.
No website, facility, system, network, device, database, or transmission method can be guaranteed to be 100% secure. You are responsible for keeping your login credentials confidential and for notifying us promptly if you believe your account or information has been compromised.

We collect this information from you, your devices, your use of Services, service providers, franchisees, affiliates, property partners, corporate wellness partners, advertising partners, and publicly available or authorized sources.
We use and disclose this information for the business and commercial purposes described in this Privacy Policy.
We do not sell personal information for money. However, some online advertising, retargeting, analytics, or pixel activity may be considered “sharing” or a “sale” under California law. California residents may opt out of such sale or sharing where applicable by using any cookie preference tool available on our website, enabling Global Privacy Control, or contacting us.
We use sensitive personal information only for purposes reasonably necessary to provide Services, protect safety and security, process payments, maintain accounts, comply with law, or for other purposes permitted by law, unless we obtain consent or provide additional notice where required.

Our websites and communications may link to third-party websites, platforms, social media pages, payment processors, booking portals, app providers, property partner sites, franchisee sites, or service providers. We are not responsible for the privacy practices, security, content, or policies of third parties.
Your use of third-party services is subject to the privacy policies and terms of those third parties.
14. Franchisees, Affiliates, and Location Operators
BIOCUBE Services may be provided by company-owned locations, franchisees, affiliates, licensees, property-based operators, or other participating locations. These parties may collect and process information to operate local services, manage memberships, provide customer support, process payments, maintain waivers, and comply with legal obligations.
BIOCUBE LLC may receive information from participating locations for brand management, franchise support, quality control, reporting, marketing, customer service, safety, legal compliance, and system-wide operations.
If a franchisee or location operator provides a separate privacy policy or additional privacy notice, that policy or notice may also apply to its processing of information.
15. International Visitors
BIOCUBE is based in the United States, and this Privacy Policy is intended primarily for U.S.-based websites, locations, and Services unless another regional policy applies.
If you access our Services from outside the United States, you understand that your information may be collected, processed, stored, and transferred in the United States or other countries where we or our service providers operate. Privacy laws in those countries may differ from the laws of your location.

To the extent permitted by applicable law, this Privacy Policy is governed by the laws of the State of Florida, without regard to conflict-of-law principles.
